2. The petitioner apprehends his arrest in connection with Rajauli P.S. Case No. 563 of 2024, registered for the offences punishable under Sections 303(2), 105, 111 of the BNS, 2023 and 3/4/5 of the Explosive Substance Act.
3. As per the prosecution story, the accused persons named in the FIR are alleged to have illegal mining of Mica by exploding the rocks. One person amongst them namely, Basudeo Bhuiyan suffered injuries due to blast and succumbed to death.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner was not arrested at the spot and nothing has been recovered from the conscious
Patna High Court CR. MISC. No.35016 of 2025(4) dt.19-09-2025 2/2 possession of the petitioner. It is further submitted that on exactly similar footing, co-accused Rahul Turiya @ Rahul Turi has been granted bail by this Court vide order dated 22.08.2025 passed in Cr. Misc. No. 47647 of 2025.
5. On the other hand, learned APP for the State has opposed the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Nawada in connection with Rajauli P.S. Case No. 563 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
7. The petitioner shall remain physically present on each and every date before the learned court below till framing of the charges.
