The appeal is admitted.

In this appeal, the appellant is seeking anticipatory bail in connection with Chautarwa P.S. Case No. 25 of 2020 registered for offence punishable under sections 323, 341, 504, 506 of the Indian Penal Code and sections 3 (i) (r) of the SC/ST (POA) Act.

In the present case, allegation has been made that the cricket ball of the son of the informant had gone to the bamboo clamps of the appellant and when the son of the informant went to bring the ball, the appellant snatched his ball, assaulted him and took his caste name. The son of the informant fled away from there and the appellant threatened to kill the entire family

The appellant has no criminal antecedent.

Looking to the facts and circumstances of the case, the impugned order dated 21.08.2020 is set aside and the appellant above named, in the event of arrest or surrender before the court below within six weeks from today, is directed to be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, SC/ST Act, West Champaran, Bettiah in connection with Chautarwa P.S. Case No. 25 of 2020, subject to condition that one of the bailors of the appellant shall be his close relative.
