The petitioner is languishing in custody since 26.09.2014 in a case registered for the offences punishable under section 302/34 of the Indian Penal Code.

The FIR was lodged when one Chhote Manjhi phoned the informant that his father has been killed. In course of investigation, Chhote Manjhi claimed himself to be eye-witness and stated that he had seen the petitioner and other accused namely, Ghultan Ravidas, Laxman Manjhi and Manogi Manjhi committing the alleged crime.

It is alleged that the considering the fact that informant has not disclosed this act of commission of the crime at the time of recording of Fardbeyan as disclosed to him by

Patna High Court Cr.Misc. No.25714 of 2015 (2) dt.23-07-2015 2/2 Chhote Manjhi, the co-accused Ghultan Ravidas has been granted bail by a co-ordinate bench of this court vide Criminal Miscellaneous No. 21601 of 2015. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurahi in connection with Masaurhi P.S. Case No.465 of 2013.
