The petitioners seek bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.
The petitioners are named in the first information report on the allegation that he along with accused Jasimuddin Ansari opened fire as a result of which firing of co-accused Jasimuddin Ansari hit the deceased who died at the spot. The impugned order of the learned Sessions Judge goes to show that only one injury was found on the person of the deceased and
Patna High Court Cr.Misc. No.16354 of 2016 (2) dt.22-04-2016 reason for the aforesaid occurrence is said to be previous dispute between the deceased and co-accused Jasimuddin Ansari. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua P.S. Case No. 52 of 2016.
