The petitioner being the husband of the complainant is languishing in custody since 05.02.2016 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.

Basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant and ready to keep her as wife with dignity and honour. A statement to that effect has been made in paragraph 15 of the petition which reads as follows :- "That the petitioner undertakes to keep the

It is further submitted that similar was the stand of the petitioner before the learned Court below but in spite of notice being issued to the complainant, the complainant failed to appear, which gets reflected from paragraph 1 of the impugned order.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Purnea, in connection with Complaint Case No.3440/2013.
