JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399 and 402 of the Indian Penal Code and 25(1-b)A, 26/35 of the Arms Act.

One country made loaded pistol, one live cartridge and two mobile sets are said to have been recovered from conscious possession of the petitioner when he along with others had assembled to make preparation for committing dacoity. Petitioner does not have any criminal antecedent and having more or less similar allegation, one co-accused, namely, Gautam Kumar @ Bhollu has already been granted privilege of bail by a Coordinate Bench of this Court.

Patna High Court Cr.Misc. No.16990 of 2016 (2) dt.28-04-2016 2/2 Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Danapur in connection with Danapur P.S. Case No.3 of 2016.
