Heard both parties.
The petitioners seek bail in Katoriya P.S. Case No. 137 of 2019, registered for the offence punishable under Sections 379 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioners along with 11 FIR named persons and 400 to 500 unknown persons assembled at the Darwaja of the informant and ransacked the house of
Patna High Court CR. MISC. No.44950 of 2021(2) dt.03-11-2021 2/2 Mahendra Pandit and set his house on fire.
It is submitted on behalf of the petitioners that there is case and counter case. The present FIR has been lodged in retaliation to Katoria PS Case No. 131/19 in which the father of petitioner no. 1 was killed by the informant side. There is general and omnibus allegation and no specific allegation of overt act has been alleged against petitioners. Petitioners are in custody since 22.02.2021 having clean antecedent. Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Katoriya P.S. Case No. 137 of 2019.
