JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant got information that some criminals were making preparation to commit crime and after that, he went there and arrested the petitioner and other accused and it is alleged that one loaded country made Katta and one live cartridge were recovered from conscious possession of the petitioner. The present case has been registered under Sections-399/402 of the Indian Penal Code and under Sections-25(i-B)A/26/35 of the Arms Act but there is nothing in the entire written report that the petitioner and his associates had assembled to make preparation for committing dacoity. Moreover, having more or less similar allegation, some co-accused have already been granted privilege

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Danapur P.S. Case No. 03 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna.
