Petitioner seeks bail in a case registered under sections 419, 420, 465, 468, 471 and 120B of the Indian Penal Code. No doubt, petitioner is named in the first information report but according to the prosecution case itself, it was co- accused Prasant Kumar who demanded and took cash and so far as the petitioner is concerned, it is only stated that he was found sitting in the office along with others.

Moreover, two co- accused, having more or less similar allegation, have already been granted privilege of bail. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Kotwali P.S. Case no. 43/2016.
