The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, while accused Shahid Raja was caught by the police personnel, the petitioner and one another managed to escape. On search a country made pistol and two live cartridges were recovered from the possession of Shahid Raja.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. His name transpired in the confessional statement of a co-

Having heard learned counsel for the parties and taking into consideration the facts of the together with the petitioner having remained in custody for over 1 year 2 months, the Court directs the petitioner to be enlarged on bail in connection with Turkauliya (Banjariya) P.S. Case no. 770 of 2020 (G.R. no. 8114/20) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari.
