====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 20-05-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Gandhi Maidan P.S. Case No.90 of 2025 instituted under Sections 352, 126(2), 127(2), 115(2), 351(2), 308(2), 3(5) of BNS and Section 27 of Arms Act.

3. As per the prosecution case, co-accused Sujit Kumar alongwith 5-6 persons started abusing the informant and on protest, co-accused Sujit Kumar fired in air from his pistol. The allegation against the petitioner is that he used to demand money from the informant and co-accused Sujit Kumar fired on the informant at the instance of petitioner.

4. Learned counsel for the petitioner submits that petitioner runs a small shop on footpath and sells/keeps readymade items and the informant used to threaten him and

Patna High Court CR. MISC. No.32897 of 2025(2) dt.20-05-2025 2/2 falsely implicated the petitioner in this case. He further submits that petitioner has no concern with the co-accused Sujit Kumar. Learned counsel submits that except the suspicion, there is no material against the petitioner. He further submits that petitioner has no criminal antecedent and he undertakes to cooperate in the investigation.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned S.D.J.M., Patna in connection with Gandhi Maidan P.S. Case No.90 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
