Petitioner is languishing in custody since 21.12.2015 in a case registered for the offences punishable under Sections 20, 22 of the Narcotics Drugs and Psychotropic Substances Act, 25(1-B)a, 26, 35 of the Arms Act.

The prosecution case is that on secret information a raid was led and two accused persons namely Bishwajeet Kumar and Vijay Kumar were apprehended from whom 4 K.g ganja each were recovered. From the possession of petitioner one country made loaded pistol and one cartridge and from possession of co-accuse Md. Shubhani Rana one country made pistol and one live cartridge were recovered.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.16750 of 2016 (2) dt.19-04-2016 no recovery has been made from the possession of the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Moreover, the investigation has already concluded. Considering the nature of recovery, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Patna in connection with Special Case No. 52 of 2015 arising out of Beur P.S.
