JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is languishing in custody since 14.04.2015 in connection with Chakai P.S. Case No. 32 of 2014 for the offences instituted under Section 304(B)/34 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the informant married his daughter Renu Kumari @ Renu Devi with Kundan Yadav in the year 2012. After marriage, she went to her Sasural where the accused persons including the petitioner demanded Rs. Two lacs and colour T.V. in dowry and she was subjected to cruelty for non-fulfilment of dowry demand. It is further alleged that on the occasion of Holi festival, she again went to her Sasural
Patna High Court Cr.Misc. No.24079 of 2015 (2) dt.06-07-2015 2/3 from her matrimonial home, then the informant also went there to see her but accused persons again demanded dowry. His daughter disclosed that two days before accused persons assaulted her and confined her in a room and did not provide food to her. It is further alleged that on 01.04.2014 the brother-in-law of his elder brother gave information to the informant that dead body of his daughter is lying in his Sasural and her husband, mother-in-law, father-in - law and Bhaisur had fled away. Then the informant reached at her Sasural and found dead body of his daughter. It is claimed by the informant that all the accused persons killed his daughter for dowry.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is the Bhaisur of the deceased and he has got no concern with the husband of the deceased. It is further submitted that other accused has been granted anticipatory bail by this Court vide Annexure-2 to the present application. It is further submitted that the petitioner is in custody since 14.04.2015. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances that the petitioner is the Bhaisur of the deceased and no specific allegation
Patna High Court Cr.Misc. No.24079 of 2015 (2) dt.06-07-2015 3/3 against him, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Jamui, in connection with Chakai P.S. Case No. 32 of 2014.
