JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in custody since 17-03-2015 in a case initially, registered under Sections-379, 411, 307, 34 of the Indian Penal Code, in which, charge sheet was submitted under Sections394/411 of the Indian Penal Code. According to prosecution case itself, petitioners were caught from their houses and so far as recovery of articles is concerned; the same has not been put on Test Identification Parade. Moreover, it appears that only household articles are said to have been recovered.

No.17558 of 2016 (2) dt.29-04-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that petitioners do not have any criminal antecedent, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Nasariganj P.S. Case No. 38 of 2015 to the satisfaction of learned Judicial Magistrate-Ist Class, Bikramganj, Rohtas.
