JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is languishing in custody since 19.03. 2015 in connection with Sugauli P.S. Case No. 91 of 2015 for the offences instituted under Sections 417, 419, 420 and 120(B) of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on the date of occurrence, the petitioner, representing himself to be an agent of the Government deputed to prepare Ration Card(Red-Card) to the applicants on the fee of Rs. 400/- per candidate. It is further alleged that he contacted the villagers and in the name of preparing Ration Card, began to extract money and in this way, he

Today, the said person again came into the villager and began to negotiate for preparing Ration Card. When this informant and the local Mukhiya, namely, Md. Shamsuddin, came to know this fact, suspicion raised in their mind and then he caught hold of the said person and began to interrogate. Then this person puzzled and did not reply satisfactorily. Then the informant and villagers phoned to B.D.O. and local S.H.O., Then both the officers came and the apprehended person(petitioner) was handed over to them to take legal action.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that as per the prosecution case it has been alleged that the petitioner has committed fraud of Rs. 8,000/- from twenty persons. It is further submitted that the petitioner is in custody since 19.03.2015.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East
