1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Bhagwanpur (Belaon) Police Station Case No. 68 of 2024 disclosing offences under Sections 387, 34 of the Indian Penal Code.

3. As per the First Information Report, on 08.03.2024, in the evening, the petitioners along with three unknown persons having firearms came on the land of the informant, demanded Rs. 2 lacs as rangdari and further demanded Rs. 50,000/- per month and threatened to kill the informant and his family members if the money is not given.

4. Learned Counsel for the petitioners submits that both the petitioners are own brothers and the informant is his cousin brother. A title suit, bearing Title Suit No. 41 of 2022, has been filed by Chandra Kali Kunwer for family partition in

Patna High Court CR. MISC. No.37637 of 2024(2) dt.03-07-2024 2/2 which the informant and his father is defendant no. 7 and 13 and the father of the petitioners are defendant no. 9 and petitioners are defendant no. 16 and 17. The petitioners have been implicated in this case due to land dispute between the parties.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that both the parties are having land dispute and title suit is pending between them, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate V, Kaimur at Bhabua, in connection with Bhagwanpur (Belaon) Police Station Case No. 68 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
