2. The accused/petitioner is not named in the F.I.R. and apprehended his arrest in connection with Ramgarh P.S. Case No. 02 of 2023 registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

3. As per FIR, 500 paddy bags were stolen from the godown of informant by unknown co-accused person.

4. Learned counsel appearing on behalf of the petitioner submitted that one Gautam Paswan was

Patna High Court CR. MISC. No.33130 of 2025(2) dt.19-05-2025 2/3 apprehended in this case and on the basis of his confession, name of petitioner transpired in the present case. It is submitted that till date nothing incriminating was recovered from the godown of this petitioner, who is also dealing with paddy business and out of trade rivalry his name was implicated with present case. It is submitted that he was not only implicated with this case but after lodging of present case he was subsequently named with three other cases of similar nature, which is a classical example of police atrocities against petitioner. It is submitted that recovery as mentioned in impugned order is in connection with Ramgarh P.S. Case No. 09 of 2023 and same is not in connection with the present case.

5. Learned APP appearing on behalf of the State, opposes the prayer for anticipatory bail.

6. In view of aforesaid facts and circumstances and by taking note of the fact as except confession nothing transpires against this petitioner, till now, accordingly the petitioner above named, in the event of his arrest or surrender before the learned Trial Court within a period of

No.33130 of 2025(2) dt.19-05-2025 3/3 four weeks, is directed to be released on bail, furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Mohania (Kaimur)/concerned Trial Court where the case is pending in connection with Ramgarh P.S. Case No. 02 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C./Section 482(2) of the BNSS.
