JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 33,41 and 42 of the Indian Forest Act.
Sixteen pieces of Seesam logs were recovered while the accused were cutting the tree. The petitioner was identified on the spot.
It is submitted by learned counsel for the petitioner that though the case was instituted in 2004 but the prosecution report was transmitted in 2011.
It appears from the impugned order that earlier anticipatory bail applications of the petitioner were rejected twice
Patna High Court Cr.Misc. No.31585 of 2014 (2) dt.02-02-2015 2/2 by the learned Sessions judge in 2011 and 2012. On that ground alone, this court is not inclined to interfere in the matter. However, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Misc.(Forest) Case no. 6 of 2004 pending in the court of learned Judicial Magistrate Ist Class, Supaul. This application is disposed of with the aforesaid observation/direction.
