Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner seeks regular bail in connection with Jogbani P.S. Case No. 301 of 2021 lodged under Section 306/34 of the I.P.C.
As per the prosecution case, it has been alleged that the son of the informant has suicide himself at the house of the petitioner. It has been alleged in the F.I.R. that on the instigation of the petitioner, the said suicide took place. Learned counsel for the petitioner submits that petitioner is a widow lady who is residing with her daughter. He submitted that she is in custody since 07.04.2022 having clean
Patna High Court CR. MISC. No.35256 of 2022(2) dt.16-09-2022 2/2 antecedent. Charge sheet has already been filed in this case. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - V, Araria in connection with Jogbani P.S. Case No. 301 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
