1. The present writ petition has been filed seeking the following relief(s):- "1. That this application is being filed by the petitioner for grant of promotion on the post of MMGS-II with effect from November, 2017 and thereafter MMGS-III with effect from May, 2021. It is also prayed that in the event of such promotion granted to the petitioner, the financial benefits and the arrears may also be granted to the petitioner with immediate effect.
i) For direction upon the respondent bank authority to comply with the order and
Patna High Court CWJC No.8214 of 2023(2) dt.05-12-2023 2/3 judgment dated 14- 15.01.2020 passed in Civil Appeal No.1567 of 2017 (Sidda Raju vs. State of Karnataka) and further in compliance of order dated 28.09.2021 delivered by the Hon'ble Supreme Court of India in the application for clarification in the same matter.
ii) The petitioner also prays for direction upon the respondent to adhere with the office Memorandum No.36012 dated 17.05.2022 issued by the Ministry of Personal, Public Grievances & Pension Department, Government of India wherein reservation in promotion to the person with Bench Mark Disability (PwBDs).
iii) The petitioner also prays for implementation of office memorandum No.36012 dated 17.05.2022 issued by the Ministry of Personal, Public Grievances & Pension Department, Government of India, wherein litigation involving reservation to persons with Bench Mark Disability, has been issued concerning to all Ministries and departments of the Government of India for ensuring strict compliance of the instructions issued therein. iv) For any other relief/reliefs which may deem fit and proper in the facts and circumstances of the case."
2. At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Assistant General Manager (Human Resource), State Bank of India, Local Head Officer Patna, West Gandhi Maidan, Patna
Patna High Court CWJC No.8214 of 2023(2) dt.05-12-2023 3/3 i.e., the respondent no. 3, for redressal of his aforesaid grievance. Liberty, so sought, is granted.
3. It is needless to state that in case appropriate Petition is filed by the petitioner before the respondent no. 3 within a period of two weeks from today, the respondent no. 3 shall consider the same, in accordance with law and pass a reasoned and a speaking order, within a period of eight weeks, thereafter.
4. The present writ petition stands disposed off on the aforesaid terms.
