The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

As per the prosecution case, three unknown miscreants on the threat of arms snatched Scorpio vehicle and mobile phone of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused. No incriminating material has been recovered from the conscious possession of the petitioner. Test Identification Parade has not

Patna High Court CR. MISC. No.44038 of 2021(3) dt.03-01-2022 2/2 been carried out till date. Petitioner is in custody since 5.4.2021.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IX, Patna in Kotwali Police Station Case No. 404 of 2019.
