Petitioner is accused in connection with Katra P.S. Case No. 17 of 2013 registered under Sections 384/387 of the I.P.C.
Learned counsel for the petitioner submits that earlier prayer of the petitioner for bail was refused by this Court on 07.03.2014 vide Cr. Misc. No. 32847 of 2013 with direction to the trial Court to conclude the trial of the petitioner preferably within one year, but one and half year has already been elapsed, as yet trial has not been concluded. It is also submitted that petitioner is in custody since 15.04.2013.

Patna High Court Cr.Misc. No.29430 of 2015 (3) dt.19-08-2015 2/2 Memo No. 2061 dated 01.08.2015, reveals that the case is pending for evidence, but the Court is vacant since 1st April, 2015 and a letter has been written to the learned District and Sessions Judge, Muzaffarpur to transfer the record for concluding the trial. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Muzaffarpur in connection with Katra P.S.
