The petitioner is languishing in custody since 10.04.2015 in connection with Dumra P.S. Case No. 07 of 2014 for the offences instituted under Sections 409, 406 and 420 of the I.P.C. The prosecution story, in brief, is that the petitioner who happens to be the Branch Manager of Parsauni and Bairgania is said to have grabbed the public money amounting to Rs.4,88,994/- by keeping the same with him and created hindrance in making payment of the people. Despite request made by the informant the petitioner did not deposit the aforesaid amount. It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.25821 of 2015 (3) dt.02-09-2015 2/2 petitioner is in custody since 10.04.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. The petitioner has been made accused in the present case due to mistake of fact. It is further submitted that the petitioner is ready to deposit an amount of Rs. 20,000/- in the court below within a period of fifteen(15) days from the date of release which shall be subject to final disposal of the case. On behalf of the State it has been submitted that allegation of misappropriation of public fund is alleged against the petitioner.

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs. 20,000/- in the court below within fifteen(15) days from the date of release which shall be subject to final disposal of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Dumra P.S.
