The petitioner is languishing in custody since 20.02.2015 in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
On theft of a tractor of the informant the FIR was lodged against unknown. The name of the petitioner sprang up on the confession of the co-accused.
Statement has been made in para 8 of the petition that there is no recovery from the possession of the petitioner.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of
Patna High Court Cr.Misc. No.24162 of 2015 (2) dt.14-07-2015 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Madhubani in connection with Bisfi P.S. Case No. 195 of 2014. Since the petitioner is accused in three other cases of similar nature, the learned court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities i.e. if he defaults for two consecutive occasions or substantially gets involved in some serious nature of offence.
