JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-01-2022 Heard both parties through video conferencing. The petitioners seek bail in Agrer P.S. Case No. 48 of 2020, registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

It is a case of dowry death. Petitioner no. 1 is brotherin-law (Bhaisur) and petitioner no. 2 is father-in-law (Sasur) of the deceased.

It is submitted on behalf of the petitioners that thrust of accusation is against husband of the deceased who is already in custody. Petitioner no. 1 is brother-in-law (Bhaisur) and petitioner no. 2 is father-in-law (Sasur) of the deceased and they are living separately and have got no concern with the family

Patna High Court CR. MISC. No.44326 of 2021(2) dt.20-01-2022 2/2 affairs of the deceased and her husband. There is general and omnibus allegation. Petitioners are in custody since 18.04.2021 having no criminal antecedents. Investigation is complete. Counsel for the informant however vehemently opposed the prayer for bail.

Considering the facts and circumstances of the case and the fact that petitioner no. 1 is brother-in-law and petitioner no. 2 is father-in-law of the deceased and there is general and omnibus allegation, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Judge IVth, Sasaram at Rohtas in connection with Agrer P.S.
