The petitioner is in custody in connection with Birupur P.S. Case No. 14 of 2015 instituted for the offences punishable under Sections 406, 409, 419, 420, 465, 466 and 467/34 of the Indian Panel Code.

The prosecution case, in brief, is that the District Programme Officer made a written complaint to the S.H.O. Birupur Barahiya making allegation of misappropriation of Government fund earmarked for development works under various Government Schemes.

It is submitted on behalf of the petitioner that the petitioner is in custody since 08.02.2016. Charge-sheet has been

As per allegation, work of Rs. 48,000/- has not been carried out by the petitioner, who is a Panchayat Rojgar Sewak. Secondly, certain bills for the works completed have also not been submitted by the petitioner. It is further submitted that the petitioner is ready to deposit an amount of Rs. 25,000/- in the court below, which shall be subject to the final disposal of the case.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

In view of the above, the petitioner is directed to deposit an amount of Rs. 25,000/- in the court below, which shall be subject to the final disposal of the case. Let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Lakhisarai, in connection with Birupur P.S.
