JUSTICE SUDHIR SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with a case registered under Sections 302, 201/34 and 120(B) of the Indian Penal Code.

The allegation against the petitioner and others is of committing the murder of Birju Sahni, brother of the informant and threw the dead body in lonely place at village- Cheria. It is submitted on behalf of the petitioner that the petitioner is in custody since 19.04.2015. Charge sheet has been submitted in this case. He has falsely been implicated in the present case. The petitioner is not named in the FIR. His name has come merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest his implication.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 3rd learned Additional District and Sessions Judge, Begusarai in connection with S.T. No. 475 of 2015 arising out of Bhagwanpur P.S.Case No. 208 of 2014.
