The petitioner seeks regular bail in connection with Kankarbagh P.S. Case No. 275 of 2019 instituted for the offences under Sections 395 and 397 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 16.12.2019 and charge-sheet has been submitted in the case.
Learned counsel for the petitioner submits that informant in the F.I.R. alleges that on 11.03.2019, nine unknown accused persons entered the house of informant and after tying all the family members, looted Rs. 25,000/-. It is further alleged that the informant also received a message that Rs. 20,000/- has been withdrawn from ATM.

No.44770 of 2021(2) dt.15-12-2021 2/3 Learned counsel for the petitioner submits that the F.I.R. is against unknown and the name of this petitioner transpired in the confessional statement of co-accused Ajit Kumar @ Ajit Sahani who has been granted bail by this Court vide order dated 18.09.2021 in Cr. Misc. No. 58868 of 2019. It is further submitted that no incriminating article was recovered from possession of this petitioner.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that petitioner has got criminal antecedents to which the learned counsel for the petitioner submits that it is because of the antecedents that the petitioner has been implicated in the present case and the police is implicating the petitioner falsely in case after case as would be evident from paragraph '3' of the bail application where the petitioner in 2019 became a criminal as four cases were instituted against him of same nature in the same year.
Considering the fact that the petitioner is in custody since 16.12.2019, charge-sheet has been submitted in the case and the co-accused Ajit Kumar @ Ajit Sahani has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five

Madhvi Singh, learned J.M., 1st Class, Patna in connection with Kankarbagh P.S.
