The petitioner is languishing in custody since 14.01.2015 in connection with Naya Ramnagar P.S. Case No. 09 of 2015 for the offences instituted under Sections 498(A) and 304(B). Later on, cognizance has been taken under Section 302 of the I.P.C.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that ten years ago the
Patna High Court Cr.Misc. No.24072 of 2015 (2) dt.06-07-2015 2/3 deceased was married with Rajesh Yadav and before four years one female issue has been born during their wedlock. It is alleged that the husband and his in-laws including the accused petitioner used to torture the victim for the dowry. Her husband has demanded one lac rupees from her Maika. On non-fulfillment of dowry, her husband threatened the deceased to perform another marriage with another girl. Having made conspiracy with this accused petitioner, they have assaulted her with lathi on her head. Thereafter, on 11.01.2015 they have brought the victim in coma. But she succumbed to the injuries on the next day on 12.01.2015. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is Bhagina of the husband of the deceased. It is further submitted that the petitioner is in custody since 14.01.2015.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances that the petitioner is Bhagina of the husband of the deceased, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Munger, in
