Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Wazirganj Case No. 96 of 2019, lodged under Sections 147, 148, 149, 341, 323, 307, 302 and 504 of the Indian Penal Code. As per the prosecution, the F.I.R. has been lodged against 11 known persons, who alleged to have assault to the deceased as informant used to play the witch craft. Learned counsel for the petitioner submits that as per the F.I.R., there is general and omnibus allegation against all 11 accused persons. There is nothing specific against the present

Patna High Court CR. MISC. No.35511 of 2022(2) dt.16-09-2022 2/3 petitioner. He further submits that petitioner is in custody since 28.03.2022 having clean antecedent. He further submits that charge sheet has already been filed in this case. He further submits that co-accused persons have been granted bail by the Co-ordinate Bench of this Court vide orders dated 16.10.2019 and 30.03.2022 passed in Cr. Misc. Nos. 40694 of 2019 and 57571 of 2021 respectively.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Ist Addl. Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S. Case No. 96 of 2019, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
