The petitioner seeks bail in Bairiya P.S. Case No. 133 of 2014, registered for the offences punishable under Sections 376, 420 and other Sections of the Indian Penal Code. It is alleged that the petitioner established physical relation with the prosecutrix on the pretext of marry with her and the prosecutrix became pregnant. She was forcefully aborted. It is submitted that the petitioner solemnized marriage and the prosecutrix went to the house of the petitioner. The petitioner assaulted her and her mother.

It appears that the prosecutrix is 21 years old. She established physical relation with the petitioner out of her free

Patna High Court Cr.Misc. No.23856 of 2015 (2) dt.14-07-2015 2/2 will. Petitioner is in jail since 18.11.2014. The police after investigation did not find the case true under Section 306. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 133 of 2014.
