This application for grant of regular bail arises out of Khagaul P.S. Case No. 57 of 2020, disclosing offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

From the First Information Report, it transpires that there is direct allegation against co-accused Rocky Kumar and Raushan Kumar of having shot at the deceased. The petitioner and other co-accused persons had allegedly surrounded the victim, whereafter he was shot at by the said co-accused persons.

Considering the petitioner's direct involvement in commission of the offence, I am not inclined to grant him the

Patna High Court CR. MISC. No.33143 of 2020(5) dt.20-02-2021 2/2 privilege of regular bail for the present.

This application is rejected.

It is, however, observed that if the charge is not framed within six months from today, the petitioner shall be at liberty renew his prayer for bail.
