2. The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections126(2), 115(2), 109, 74, 352, 3(5) of BNS and section 27 of the Arms Act.
3. Allegation against the petitioners is to open fire upon the husband of the informant and also assaulted by using butt of the pistol causing head injury.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.34129 of 2025(3) dt.15-09-2025 2/3 petitioners are innocent and they have been falsely implicated in this case. The petitioners are next door neighbours of the informant. A counter case has been filed by petitioners' mother against the informant of the present case. As per injury report mentioned in para-52 of the case diary the injured have sustained injury by hard and blunt substance and have not sustained any firearm injury. It is further submitted that co-accused Roushan Kumar @ Roushan Singh has already been granted bail vide order dated 09.09.2025 passed in Cr. Misc. No.48384 of 2025. The petitioners are in custody since 01.01.2025 having clean antecedent.
5. Learned APP appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.
6. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail, in connection with Kharik P.S. Case No. 01 of 2025 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two
