JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but the informant claimed that deceased had gone to the house of the petitioner but, subsequently, the dead body of the deceased was found near a canal.

Learned counsel for the petitioner submits that the cause of death of the deceased was found to be strangulation and, moreover, co-accused Dina Sahani has already been granted privilege of bail privilege of bail by a co-ordinate Bench of this Court.

Admittedly, none has seen the actual killing of the

Patna High Court Cr.Misc. No.18961 of 2016 (2) dt.04-05-2016 2/2 deceased and except suspicion, there is nothing against the petitioner, who is languishing in jail custody since 02.02.2016. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in connection with Turkaulia P.S.Case No. 724 of 2015.
