JUSTICE SATYAVRAT VERMA ORAL ORDER 10-12-2021 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of Covid 19 pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Excise Case No. 456/2021, arising out of Arwal P.S. Case No. 158 of 2021 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.06.2021, and is a person of clean antecedent and charge-sheet has been submitted, allegation is of recovery of 2880 litres of liquor from a container

Learned counsel further submits that petitioner was apprehended who disclosed that he was cleaner of the vehicle. Learned counsel submits that petitioner is neither the driver nor the owner of the vehicle in question but is the cleaner of the vehicle and as such was not aware what was being transported in the container.

Learned APP for the State opposes the prayer of regular bail application of the petitioner.

Considering the fact that the petitioner is in custody since 10.06.2021, charge-sheet has been submitted in this case and the petitioner, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum- Special Judge, Excise, Jehanabad in connection with Excise Case No. 456/2021, arising out of Arwal P.S.
