The petitioner apprehends his arrest in a case registered for the offence punishable u/s 366(A)/34 of the IPC and section 6/8 of POCSO Act.

As per the F.I.R., the daughter of the complainant was kidnapped by the petitioner with an intention to marry her. The father of the petitioner assured to return the daughter of the informant but after 2-4 days, she came at the house of accused persons then all of then started abusing. It is alleged that the daughter of the informant was killed after kidnapping and sexual assault by the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He
Patna High Court CR. MISC. No.35293 of 2023(3) dt.28-08-2023 2/2 has been falsely implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged, has ever taken place. It is submitted that police has recovered a letter written by the victim, in which, it was disclosed that she on her free will left this house, neither any grievance to her family nor any grievance to her mother's maternal house family. The said letter is enclosed at Annexure-2 of the bail petition and it has also come in the case diary. Petitioner has no criminal antecedent. 5.
Learned APP for the State opposed the prayer for bail. 6.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Chhauradano (Mahuawa) P.S. Case No.348/2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
