JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 325, 307, 353, 332, 333, 504, 506 of the Indian Penal Code.

As per allegation in the F.I.R, two groups of persons about 100-150 assembled and started hurling, abuses and also pelted stones caused injury to three police personnel. Learned counsel for the petitioner submits that petitioner has falsely implicated in this case. General and omnibus allegation levelled against the petitioner. He is only a member of unlawful assembly. On similar footing some coaccused has been granted bail in Cr. Misc. No. 3001 of 2020

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the above named petitioners, in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, -VI, Bhabhua, Kaimur in connection with Kudra P.S.Case No. 319 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
