The case is registered under sections 366A/34 of the Indian Penal Code, in connection with Jamalpur P.S. Case No. 191 of 2021 of 2021.

As per the prosecution story, the informant's minor daughter went out of home for taking medicine but failed to return. Later, they came to know that the petitioner is the man behind her disappearance as also his family members and the same has been done for the purposes of marriage. Subsequently, the victim girl was recovered and

Patna High Court CR. MISC. No.35557 of 2022(2) dt.16-09-2022 2/3 she had made statement under Section 164 of the Cr.P.C. which is part of the bail application. As per the said statement, she is 18 years of age and has further narrated that she has solemnized marriage with the petitioner herein and wanted to live away from her parents. She further stated that the marriage took place in the temple of Dhanbad and she wants to live with her in-laws. Taking into account the aforesaid facts that the victim girl who has stated her age to be 18 years under Section 164 of the Cr.P.C. and has further stated that she has married the petitioner on her own and wants to live with him, this Court is inclined to grant him the privilege of bail.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.D.J-VIth Special Judge, Munger, in connection with Jamalpur P.S. Case No. 191 of 2021 of 2021 subject to the following conditions: (i) one of the bailors should be the family members of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of

(iii) he shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.

With the aforesaid observations, the bail application is allowed.
