Petitioner apprehends arrest in a case registered for the offences punishable under Sections 307/379/504/34 of the Indian Penal Code.

Prosecution case in short is when informant's son was sitting at his door, the petitioner and one Chittu Kumar came on a motorcycle and started abusing him and on protest the petitioner took him at some distance forcibly by dragging where co-accused Chittu Kumar gave knife blows on his back. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. There is a case and counter case and the main allegation of assaulting the victim with knife is against co-accused Chittu Kumar. Considering the facts of the case, let the petitioner,

No.34826 of 2019(2) dt.29-05-2019 2/2 above named, in the event of his arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pramod Ranjan, Judicial Magistrate 1st class, Saran in Dighwara Police Station Case No. 111 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
