The petitioner seeks bail in connection with Rohtas (Amjhor) P.S. Case No.135 of 2015 (Sessions Trial No.46 of 2016) registered under Sections 363, 365 and 364(A) of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, it was detected that SIM No.7033691372 was being used in the mobile set belonging to the co-accused Niranjan Pal for demanding the ransom at the mobile belonging to the grand son of the informant bearing SIM No.8084542223 and not in the
Patna High Court Cr.Misc. No.18949 of 2016 (3) dt.14-07-2016 2/2 mobile set of this petitioner. The name of the petitioner has come only in the confessional statement of the co-accused Niranjan Pal in the kidnapping and murder of the victim/deceased, the grand son of the informant. Except that, there is nothing against the petitioner to show his involvement in the commission of the alleged offence. The petitioner having no criminal antecedent is in custody since 09.11.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd court of the Additional Sessions Judge, Rohtas at Sasaram, in connection with Rohtas (Amjhor) P.S. Case No.135 of 2015 (Sessions Trial No.46 of 2016).
