2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act .

3. It is alleged that 125 liters of country made liquor has been recovered from alto car.

4. It is submitted that only on the basis of suspicion petitioner has been made accused in this case. Petitioner is neither the owner nor driver of the car. No incriminating material has been recovered from the conscious possession of the petitioner.

5. Learned counsel for the State submits that petitioner has got one criminal antecedent of similar nature.

6. Considering the facts of the case as also the fact that petitioner has got criminal antecedent of similar nature, prayer for anticipatory bail is rejected.
