JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is languishing in custody since18.4.2015 in connection with Gopalganj Town P.S. Case No.125 of 2015 for the offences instituted under Sections 323, 324, 307, 302, 379, 448 and 34 of the I.P.C. and Section 27 of the Arms Act. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on15.4.2015 six miscreants come on motorcycle to the shop of the informant and four of them demanded a shirt. The informant gave them one shirt and asked for Rs.500/- of the same upon which they threatened him for dire consequences. The deceased resisted on demanding in course of which hot exchange between them took place and coaccused Milan Singh gave knife blow in the stomach of the

Patna High Court Cr.Misc. No.24636 of 2015 (3) dt.12-08-2015 2/2 deceased. Immediately thereafter the victim was taken to Gorakhpur hospital for treatment but he died in the way. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.4.2015 and the charge sheet has submitted in the present case. The petitioner's name has come in course of investigation. As per allegation the petitioner is said to have caused a single dagger blow in the stomach of one Satish. There is no allegation of causing any injury upon deceased.It is further submitted that the petitioner may be released after completion of eight months in custody.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of eight months in custody on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj, in connection with Gopalganj (Town)P.S.
