JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 370 of the Indian Penal Code and Section 16 of Bonded Labour System Abolition Act, 1976. Petitioner was arrested on the charges that he was found engaged in human trafficking and some children were recovered from possession of the petitioner but submission on behalf of the petitioner is that the rescued children were going along with petitioner with consent of their respective guardians and moreover, petitioner is in jail custody since 22.01.2016 without having any criminal antecedent. It is also pointed out that having more or less similar allegation, some co-accused have

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Railway 1st Class, Samastipur in connection with Darbhanga (Rail) (Sitamarhi) P.S. Case No. 07 of 2016, subject to condition that one of the sureties shall be local and holder of landed property.
