The petitioner apprehends his arrest in Jamo Bazar P.S. Case No.111 of 2020, registered under Sections 272, 273, 308 and 34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant, SI of Police, got information about selling of liquor and keeping the same in the house of the petitioner. The house of the petitioner was raided and from the cattle shade of the petitioner, 3 litres of country made liquor made of Mahua was recovered.

Learned counsel for the petitioner submits that the recovery is not made from the conscious possession of the petitioner, but it appears from the seizure list that the recovery

Patna High Court CR. MISC. No.35363 of 2020(2) dt.19-03-2021 2/2 was made from the cattle shade of the petitioner. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
