JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

No doubt, petitioner carries criminal antecedent of several cases but informant is said to have sustained two injuries, out of which one injury was found on right parietal region and the same was simple in nature, said to be caused by hard and blunt substance. So far as so-called second injury is concerned, the doctor only perused the X-ray of skull AP viewed and referred the informant to Sadar Hospital and up till now, the concerned doctor

Patna High Court Cr.Misc. No.16084 of 2016 (2) dt.26-04-2016 2/2 did not give any opinion regarding the nature of so-called second injury. Moreover, there appears to be previous litigation between the parties.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut (Kalyanbigha) P.S.
