The petitioner seeks bail in connection with Shastrinagar P.S. Case No.153 of 2015 for the offence punishable under Sections 420, 465, 468 and 471 of the Indian Penal Code. The prosecution story, in brief, is that during investigation in connection with Shastri Nagar P.S. Case No.120 of 25 regarding missing of a girl Priya Roy from D.A.V. Public School, B.S.E.B, New Punaichak, Patna , it came to light that this petitioner and other teachers along with the Principal of the said School were found indulged in commission of forgery work through which they used to fail the students and again after obtaining money from them, they were allowed to fill up their examination forms for appearing at the Board Examination which is against the Rules. In this way, the
Patna High Court Cr.Misc. No.25061 of 2015 (2) dt.11-06-2015 2/2 petitioner along with co-accused persons allegedly were playing foul with the career of the students, which gave rise to the institution of the present case.
It has been submitted on behalf of the petitioner that the petitioner is not named in the first information report and his name has come in the confessional statement of the co-accused. Further it has been submitted that other co-accused, namely, Sanatan Maharana, who has been named in the FIR, has been granted bail by a Bench of this Court vide Cr. Misc.No. 25089 of 2015. It has further been submitted that the petitioner has got no criminal antecedent and he is in custody since 20.03.2015. On behalf of the State it has been submitted that the petitioner's name has figured in the confessional statement of the co-accused.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Mrs. Indrani Kisku, Judicial Magistrate, Ist Class, Patna in connection with Shastrinagar P.S. Case no.153 of 2015.
