Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 341, 307, 323, 379, 324 and 34 of the Indian Penal Code, registered in connection with Digha P.S.Case No. 279 of 2021.

As per allegation, the present petitioner assaulted with dab on the head of the informant and snatched Rs. 800/- from his pocket.

The learned counsel for the petitioner has submitted that both the parties are co-villagers. The petitioner has falsely been implicated in this case. As per the injury report, no evidence of any fracture injury has been found. Mr. J.N.Thakur, the learned APP for the State, though

Patna High Court CR. MISC. No.44282 of 2021(3) dt.28-06-2022 2/2 opposed the prayer for bail, but fairly admitted that as per the medical report, no any fracture injury was found on the person of the informant.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Patna in connection with Digha P.S.Case No. 279 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
