JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-12-2020 Heard Mr. Ravi Ranjan, learned counsel for the petitioner and Mrs. Pushpa Sinha-1, Additional Public Prosecutor for the state through video conferencing.

2. Petitioner seeks regular bail in connection with Pandol PS Case No. 283/2019 registered for the offence punishable under Sections 302, 201/34 of the IPC.

3. The allegation, as per First Information Report, is that the daughter of the informant was married with son of the petitioner about thirteen years ago and out of the said wedlock, one girl child was born. It is further alleged that on 15.11.2019, the informant got a telephonic call that in-laws of his daughter has killed her and cremated her dead body.

4. Learned counsel for the petitioner submits that the petitioner is father-in-law of the deceased and he has not committed any offence in the manner alleged and the deceased has died of some ailment and the parents of the deceased along with other family members participated in her funeral. Learned counsel next submits

Patna High Court CR. MISC. No.35389 of 2020(2) dt.22-12-2020 2/2 that petitioner is in custody since 15.11.2019 and the husband of the deceased is already under custody.

5. Learned counsel further submits that the charge-sheet has been submitted in this case against the petitioner and there is no likelihood that petitioner will abscond or tamper with the evidence.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 15.11.2019 and charge-sheet has been submitted in this case against the petitioner and there is no likelihood that petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner.

7. Accordingly, let the petitioner, GULAM SADAY be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Pandol PS Case No. 283/2019.

8. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing. (Anil Kumar Sinha, J) perwez U T
