Petitioners are in custody in connection with Garkha P.S. Case No. 237 of 2020 for the offence under sections 399, 402, 413, 414, 420, 468, 34 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent.

Allegation against these petitioners is that they were members of the assembly, planning for committing loot. The petitioners were apprehended by the police and during search one Hero Splendor Motorcycle and one Samsung mobile was recovered from the possession of petitioner no.1 and one Hero

Patna High Court CR. MISC. No.34863 of 2020(2) dt.25-01-2021 2/2 Splendor Motorcycle was recovered from the possession of petitioner no.2.

It is alleged that the motorcycles were stolen one which were purchased by the petitioners from one Dilip Mahto. The petitioners are in custody since 5.6.2020. Considering the fact that the petitioners have no criminal antecedent and they are in custody since 5.6.2020, the Court is inclined to grant bail to the petitioners, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Saran at Chapra, in connection with Garkha P.S. Case No. 237 of 2020.
