Misc. applications have arisen out of the same occurrence and as such they are heard together and are being disposed of by passing this common order.
2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
3. The petitioners have preferred this application for
Patna High Court CR. MISC. No.33298 of 2025(2) dt.26-05-2025 2/3 grant of regular bail in connection with Singhiya P. S. Case No. 07 of 2025 registered for the offences punishable under Sections 336(3), 338, 340, 316(2), 3(5) of B.N.S.
4. As per the prosecution case, allegation against the petitioners is to execute a forged and fabricated sale deed in favour of informant after taking entire consideration amount.
5. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is well known to the informant and the present case is instituted only with a view to harass the petitioner due to previous dispute between the parties.
6. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
7. During course of argument learned counsel for the petitioners submits that both the petitioners are husband and wife and they are ready to return the entire consideration amount of Rs. 4,98,000/- within one month.
8. Keeping in view the aforesaid facts, let the petitioners above named, be released on bail subject to condition that petitioners will produce the deposit receipt of above amount at the time of filing bail bond on furnishing bail bonds of Rs.
Patna High Court CR. MISC. No.33298 of 2025(2) dt.26-05-2025 3/3 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J. M. 1st Class Rosera at Samastipur in connection with Singhiya P.S. Case No. 07 of 2025.
